These Terms govern your use of The Marketplace Auctions, an online auction marketplace operated from 18498 E Colonial Dr, Orlando, FL 32820. By creating an account or placing a bid you accept these Terms.
1. Eligibility and accounts
You must be at least 18 years old and legally able to enter into contracts. You must register with accurate full name, email, phone, address, ZIP code and country, and keep that information current.
You are responsible for all activity under your account, including bids placed by anyone using your credentials. Notify us immediately if you suspect unauthorized access.
2. The marketplace role
The Marketplace Auctions provides the platform that connects sellers and bidders. Unless expressly stated, we are not the owner of the items listed and we do not take title to them.
Listings, descriptions, photos, videos and condition reports are supplied by sellers. We review submissions before approval but cannot guarantee the accuracy of seller-provided content.
3. Bids are binding
Every bid is a binding offer to purchase at that amount. Bids cannot be retracted once placed. Where anti-sniping is enabled, bids placed near the close extend the auction.
Winning bidders must complete payment and removal within the deadlines stated in the listing. Non-payment may result in deposit forfeiture, account suspension and re-listing of the lot.
4. Fees and deposits
Buyer premiums, seller commissions and any required bid deposits are disclosed on each listing before you bid. Where a deposit is required, bidding is unlocked only after the deposit is paid.
Deposits for unsuccessful bidders are released after the sale closes. Deposits may be retained where a winning bidder fails to complete the purchase.
5. Prohibited conduct
You may not manipulate bidding (shill bidding, bid shielding, coordinated bidding), scrape the platform, interfere with its operation, or contact other users to complete a sale off-platform.
We may cancel bids, remove listings, and suspend accounts that violate these Terms or applicable law.
6. Disclaimers and limits
Except where stated in writing, items sell AS-IS, WHERE-IS with no warranty of any kind. Inspection is your responsibility.
To the fullest extent permitted by law, our aggregate liability arising from a transaction is limited to the fees we collected on that transaction.
7. Governing law and changes
These Terms are governed by the laws of the State of Florida. Disputes are resolved in the state or federal courts located in Orange County, Florida.
